Terms of service

Last updated

These terms are an agreement between you and Rust in Peace ("RIP", "we", "us"). They apply when you use this website, play on our Rust servers, join our Discord or buy a Package. By doing any of these you agree to them, and to our rules, privacy policy and refund policy. If you don't agree, please don't use our services.

Who we are

RIP is a community that runs servers for the game Rust, based in the United States. We're not affiliated with or endorsed by Facepunch Studios, which makes Rust, or Valve, which runs Steam. Rust is a trademark of Facepunch Studios, and Steam is a trademark of Valve Corporation.

Who can use our services

There's no minimum age to play, but Rust is made for mature players and our servers aren't aimed at children. If you're under 18, or under the age of majority where you live, you need a parent or guardian's permission to buy a Package, and they accept these terms for you.

You also have to follow Steam's and Rust's own terms. You can't play on a server you're banned from, or use another account to get around a ban.

Your Steam account

You sign in with Steam, and RIP never sees your Steam password. Packages belong to the Steam account they were bought for and can't be moved to another account. You're responsible for your Steam account and what happens on it, and we can't move Packages from a lost or stolen account to a new one.

Rules and conduct

Everyone on our servers and in our Discord follows the rules. On this website, don't:

  • attack, overload or try to break into the site, the store or our servers;
  • scrape the site in a way that slows it down for others;
  • pretend to be RIP staff or another player;
  • use the store for fraud, including paying with a payment method you're not allowed to use.

Staff can warn, mute, kick or ban players, and remove names, signs or messages that break the rules. Some bans are issued automatically by anti-cheat systems.

Bans and appeals

A ban can cover one server or every RIP server, and can be temporary or permanent. While you're banned you can't use those servers or the Packages on them, and a ban for breaking the rules doesn't entitle you to a refund.

You can appeal any ban, including an automatic one, in a ticket in our Discord, and a staff member will review it. If your appeal succeeds, Packages that are still within their time are restored. Time that ran out during the ban isn't added back.

Packages

A Package is a set of in-game perks, such as Queue Skip, Chat Color Picker or Premium Raid Alerts, delivered to the Steam account it was bought for. It works on one Server, or on every Server for a Global Package, and lasts for a set time (1 or 4 weeks) or is permanent.

"Permanent" means for as long as the Server the Package is tied to keeps running or, for a Global Package, for as long as RIP runs servers. It doesn't mean forever.

A Package gives you a personal license to use its perks. It isn't property, has no cash value, and can't be sold, traded or exchanged for money.

Buying

PayNow Services, Inc. sells Packages for us as the merchant of record. It takes your payment and charges any sales tax or VAT, and its Buyer Agreement also applies to your purchase. We deliver the Package and support it.

Prices are set in US dollars. The store also shows them in your local currency, and checkout shows the final amount including tax. We can change prices at any time, but a change never affects a purchase you've already made. If a price is clearly wrong because of a mistake, we can cancel the order and refund it.

Gifts

You can gift a one-time Package to another player by their SteamID64. Check that you picked the right player before you pay: the Package belongs to them once it's bought, and gifts are final except where the law requires otherwise.

Subscriptions

A subscription renews automatically at the price and interval shown when you buy, for example every 4 weeks, until you cancel. You can cancel at any time from My subscriptions. Cancelling stops the next payment. You keep the perks until the end of the period you've paid for, and payments already made aren't refunded.

If the price of your subscription changes, we'll tell you before the new price applies, and you can cancel before then. If a payment fails, the subscription can end and its perks stop.

Refunds and chargebacks

All purchases are final, except that we refund a Package that doesn't work and that staff can't fix, and any purchase the law where you live says must be refunded. PayNow processes refunds to your original payment method. The refund policy has the details.

If you're in the EU or the UK: a Package starts as soon as you pay. By buying, you ask for it to be delivered immediately and accept that you lose your 14-day right to cancel once delivery starts. This doesn't affect your other legal rights, such as a remedy for a Package that doesn't work.

If you open a chargeback or payment dispute instead of contacting us, the Steam account is permanently banned from every RIP server.

Changes to servers and Packages

Servers, maps, wipe schedules, plugins and perks change over time, and wipes reset progress by design. We can change, rename or stop selling any Package. Servers can go down for maintenance or for reasons outside our control, and we don't guarantee they'll always be available.

If a Server closes for good, Packages tied to it end, and they aren't refunded or moved to another server, except where the law requires otherwise. Global Packages keep working on the Servers that remain.

Your content

You keep ownership of what you create on our services, such as chat messages, player and team names, signs and ticket messages. You let us host, show and use it to run our servers, website and Discord, for example showing your in-game name on leaderboards, and we can remove anything that breaks the rules.

Our content

The website, its text, logo and art belong to RIP or to the people who license them to us. You can share links to our pages, but don't copy our content or branding for your own projects without asking.

Other services

Steam, Discord, PayNow, Steamcord and BattleMetrics are run by other companies under their own terms, and we aren't responsible for them. The same goes for any other site we link to.

Disclaimers

Our servers, website, Discord and Packages are provided "as is" and "as available". As far as the law allows, we make no promises about them beyond what these terms say, including that they'll be uninterrupted, error-free or fit for a particular purpose. In-game items and progress have no real-world value.

Limitation of liability

As far as the law allows, RIP and its owners, staff and volunteers aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost progress, items, data or play time, including from wipes, outages, bans or bugs.

As far as the law allows, our total liability for any claim about our services is limited to the greater of what you paid us in the 12 months before the claim, or US$50.

Indemnity

If you break these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs, as far as the law allows.

Nothing in these terms takes away rights you have under consumer laws that can't be waived, such as those of the EU, the UK, Canada or Australia. Where these terms conflict with those laws, those laws win.

Ending your use

You can stop using our services at any time. To stop a subscription renewing, cancel it from My subscriptions. We can suspend or end your access if you break these terms or the rules, open a chargeback, or if the law requires it. Parts of these terms that by their nature should last after that, such as liability and disputes, keep applying.

Disputes

These terms are governed by the laws of the Commonwealth of Massachusetts and applicable US federal law, without regard to conflict-of-law rules.

If you have a problem, contact us first and give us 30 days to try to sort it out. If we can't, either of us can bring a claim in a small claims court that has jurisdiction, or in the state or federal courts located in Massachusetts, and we both agree to those courts' jurisdiction.

If you live outside the United States, you also keep the protection of the mandatory consumer laws of your country, and you can bring a claim in your local courts.

Changes to these terms

We may update these terms. When we do, we'll change the date at the top, and if a change is significant we'll also announce it in our Discord. Using our services after a change means you accept the new terms. A change doesn't affect a purchase you've already made, but it applies to a subscription from its next renewal.

General

These terms, with the documents they link to, are the whole agreement between you and RIP about our services. For purchases, PayNow's Buyer Agreement applies too. If part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we can still enforce it later. You can't transfer your rights under these terms, but we can transfer ours, for example to a new owner of RIP. We aren't responsible for delays or failures caused by events outside our reasonable control.
